Samsta Fitness Online Coaching Terms and Conditions
Last updated: August 2026
1. About these Terms
These Terms and Conditions apply to services supplied by Samsta Fitness Ltd, company number 16801864, trading as Samsta Fitness ("Samsta Fitness", "we", "us" or "our"), through www.samstafitness.com, our fitness application and associated services.
By purchasing, registering for or using our paid Online Coaching service, you agree to these Terms and Conditions.
These Terms should be read together with the service description, price, payment information and Privacy Policy provided to you before purchase.
The price applicable to your coaching service will be the price agreed with you and displayed or communicated to you before you complete your purchase ("the Agreed Price").
Nothing in these Terms affects any statutory rights that you have as a consumer.
2. Our Services
Samsta Fitness provides online fitness coaching services which may include, depending on the package purchased:
-
personalised training programmes;
-
exercise instruction and demonstrations;
-
fitness and progress monitoring;
-
nutritional guidance;
-
access to our fitness application;
-
online communication and coaching support;
-
programme reviews and adjustments; and
-
other features described on our website or agreed with you before purchase.
The exact services included in your package will be those described or agreed with you before you purchase.
Access to the fitness application and coaching services is provided for the duration of your active coaching agreement.
3. The 30-Day Challenge
The Samsta Fitness 30-Day Challenge is currently provided free of charge.
Unless expressly stated otherwise, the 30-Day Challenge provides general training programmes rather than individually tailored coaching.
Personalised coaching, personalised nutrition guidance and individually designed training programmes are provided as part of our paid Online Coaching services where included in the package selected.
Access to the 30-Day Challenge, including access to the fitness application and any programme content provided as part of the challenge, is available for 30 days from the date the challenge begins.
At the end of the 30-day period, your access to the fitness application and the 30-Day Challenge programme will end unless you have subscribed to one of our paid Online Coaching services.
If you continue with a paid Online Coaching service, your access to the fitness application will continue for the duration of your active paid coaching agreement.
We reserve the right to amend, replace or discontinue the free 30-Day Challenge at any time.
4. Age Requirements
You must normally be at least 18 years old to purchase our services.
A person aged 16 or 17 may only use our paid services where we have agreed to this in advance and a parent or legal guardian has provided appropriate consent and accepted responsibility for payment.
We may refuse an application where we consider our services inappropriate for the prospective client.
5. Your Account
You are responsible for keeping your account and login information secure.
You must not knowingly allow another person to access your account or use our services through your login details.
You must notify us promptly if you believe your account has been accessed without your permission.
We are not responsible for losses caused by your failure to keep your login details secure unless the loss was caused by our own breach of duty or negligence.
6. Health, Medical Conditions and Exercise Safety
Samsta Fitness provides fitness coaching and general nutrition guidance. We do not provide medical diagnosis, medical treatment or medical advice.
You are responsible for ensuring that you are medically able to participate in the exercise programme provided to you.
You must provide accurate and relevant information about any injury, medical condition, pregnancy, medication, physical limitation or other circumstance which could affect your ability to exercise safely or follow nutritional guidance.
Where appropriate, we may recommend that you obtain approval or advice from a doctor, physiotherapist, registered dietitian or other suitably qualified healthcare professional before beginning or continuing a programme.
If you experience pain, dizziness, unusual shortness of breath, faintness or other concerning symptoms during exercise, you should stop exercising and seek appropriate medical advice.
Our exercise demonstrations, instructions and coaching are intended to help you perform exercises safely and effectively. However, remote coaching cannot provide the same level of physical supervision as an in-person coach.
You remain responsible for exercising within your capabilities and using appropriate equipment and surroundings.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for death or personal injury caused by our negligence.
7. Nutrition Guidance
Any nutritional information provided by Samsta Fitness is intended as general fitness and lifestyle guidance unless expressly stated otherwise.
It is not medical nutrition therapy and should not replace advice from a doctor, registered dietitian or other suitably qualified healthcare professional.
If you have a diagnosed medical condition, history of disordered eating, food allergy, pregnancy or other condition which could affect your nutritional requirements, you should seek appropriate professional advice and inform your coach of any relevant restrictions.
8. Results
Fitness results vary between individuals.
Results depend on many factors outside our control, including adherence to the programme, nutrition, training history, lifestyle, sleep, stress, genetics, health and consistency.
Samsta Fitness does not guarantee any particular amount of weight loss, muscle gain, strength improvement, body composition change or other specific outcome.
We will, however, provide the services included within your coaching package with reasonable care and skill.
9. Price and Initial Three-Month Commitment
When you join the Online Coaching programme, the price payable will be the Agreed Price shown or communicated to you before purchase.
When first joining the Online Coaching programme, you agree to a minimum initial commitment of three calendar months ("the Initial Commitment Period").
The full amount due for the Initial Commitment Period is payable upfront when you join, unless a different payment arrangement has been expressly agreed with you in writing.
Your Initial Commitment Period begins on your agreed coaching start date. Unless another start date has been expressly agreed with you in writing, this will be the date your paid coaching service begins.
Your initial payment covers the full Initial Commitment Period.
The Initial Commitment Period is a minimum contractual commitment. You cannot terminate the service for convenience before the end of the Initial Commitment Period and receive a refund for unused time, except where you have a statutory right to cancel, where we agree otherwise, or where you have another legal right to a refund.
10. What Happens After the Initial Three Months
Your coaching agreement does not automatically end after the Initial Commitment Period.
Unless you have given valid notice of cancellation in accordance with section 11, your membership will automatically continue after the Initial Commitment Period on a monthly rolling basis.
After the Initial Commitment Period, you will be charged the Agreed Price for your ongoing monthly coaching using the payment method associated with your account.
The monthly recurring price applicable to you will be the price agreed with you before you purchased the service, subject to any subsequent change which has been validly agreed or notified to you in accordance with these Terms and applicable law.
Each monthly payment provides access to the coaching service for the relevant monthly billing period.
Payments will continue automatically each month until your membership is cancelled in accordance with these Terms.
The automatic continuation of the service, the applicable recurring price and the requirement to provide notice to cancel will be made clear to you before you complete your purchase.
11. Cancelling Your Coaching
You may submit a cancellation request at any time.
Cancellation requests should be submitted using our Membership Management Form:
https://challenge.samstafitness.com/membership-management-form-page
Using this form provides both you and Samsta Fitness with a record of your cancellation request.
Cancellation during the Initial Commitment Period
The Initial Commitment Period remains a minimum three-month commitment.
You may give notice at any time during the Initial Commitment Period that you do not wish your coaching to continue once the Initial Commitment Period has finished.
To end your membership at the conclusion of the Initial Commitment Period and prevent the first monthly recurring payment from becoming due, we must receive your cancellation notice at least one calendar month before the end of your Initial Commitment Period.
You may provide this notice at any earlier point during your Initial Commitment Period.
Giving cancellation notice during your Initial Commitment Period does not cause your coaching to finish immediately. You will continue to receive coaching until the end of the Initial Commitment Period that you have already paid for.
If your cancellation notice is received less than one calendar month before the end of your Initial Commitment Period, the required notice period has not been satisfied. Your membership will therefore continue into the monthly rolling period and the next monthly recurring payment will become payable.
Cancellation after the Initial Commitment Period
Following completion of the Initial Commitment Period, your membership operates on a monthly rolling basis and requires one calendar month's notice to cancel.
You may submit your cancellation request at any time.
To prevent an upcoming monthly payment from becoming due, we must receive your cancellation request at least one calendar month before the date that payment is due.
If fewer than one calendar month remains before your next scheduled payment when we receive your cancellation request, that payment will still become payable and your membership will continue for the period covered by that payment.
Your membership will subsequently end once the required notice period has been completed.
For example, if your recurring payment date is the 10th of each month and you want your membership to finish before the payment due on 10 September, your cancellation notice must be received no later than 10 August.
Cancellation does not normally entitle you to a refund for a coaching period which has already been paid for, except where required by law.
12. Cooling-Off Rights for Online Purchases
If you are a UK consumer entering into this agreement online or at a distance, you will normally have a legal right to cancel the contract within 14 days of entering into it without giving a reason.
This statutory cooling-off right is separate from the contractual cancellation arrangements described elsewhere in these Terms.
If you ask us to begin providing your coaching service during the 14-day cooling-off period, you expressly request that performance of the service begins before that cooling-off period has expired.
If you subsequently exercise a valid statutory cancellation right after we have begun providing services at your request, we may deduct or charge a reasonable proportion of the Agreed Price for services properly supplied up to the date you notified us of cancellation, where permitted by law.
Your statutory rights are not affected by the three-month minimum commitment.
Where digital content is supplied as part of the service, any statutory rules concerning the immediate supply of digital content and cancellation rights will also apply.
13. Failed or Late Payments
You are responsible for ensuring that a valid payment method is available for recurring payments.
If a payment fails, we may attempt to collect the payment again using the payment method associated with your account.
We may temporarily suspend access to coaching, the fitness application or other paid services while a payment remains overdue.
Suspension of access does not automatically cancel your membership or remove your responsibility to pay amounts which are properly due under these Terms.
We will not charge amounts which you do not legally owe.
14. Pausing Your Coaching
Pauses are not automatically available as part of the coaching programme.
However, where illness, injury, pregnancy or another exceptional circumstance prevents you from participating for an extended period, you may request a temporary pause through:
https://challenge.samstafitness.com/membership-management-form-page
We may ask for reasonable supporting information where necessary.
Any pause, its duration and its effect on your payment dates or Initial Commitment Period must be agreed by us in writing.
Unless otherwise agreed, a pause does not constitute cancellation of your coaching agreement.
15. Your Responsibilities
To allow us to provide effective coaching, you agree to:
-
provide accurate information about your health, goals, training experience and circumstances;
-
tell us about relevant changes which may affect your programme;
-
use equipment responsibly and follow reasonable safety instructions;
-
follow the programme at an appropriate level for your abilities;
-
communicate with your coach where you experience problems with the programme; and
-
avoid intentionally providing misleading or incomplete information which could affect the safety or suitability of your coaching.
16. Use of the Services
Our services are provided for your personal, non-commercial use.
You must not:
-
sell or resell access to our services;
-
share paid programmes or account access with other people;
-
copy or redistribute our coaching materials without permission;
-
use our services for an unlawful purpose; or
-
use our systems in a way which deliberately interferes with or damages our website, application or services.
17. Intellectual Property
All training programmes, videos, written materials, graphics, branding, educational materials, programme structures and other original content supplied by Samsta Fitness remain the intellectual property of Samsta Fitness Ltd or the relevant rights holder.
Purchasing coaching gives you a personal licence to use the materials for your own training during your membership.
It does not transfer ownership of our intellectual property to you.
You may not reproduce, publish, distribute, sell, commercially exploit or make our materials publicly available without our written permission.
18. Our Responsibility to You
We will provide our services with reasonable care and skill.
We are responsible for losses which are a foreseeable result of our breach of these Terms or our failure to use reasonable care and skill.
We are not responsible for losses that:
-
were not reasonably foreseeable when the contract was entered into;
-
arise from information you failed to disclose to us where that information was reasonably necessary for us to provide the service safely;
-
arise from your failure to follow reasonable safety instructions;
-
arise from use of the programme in a way that we could not reasonably have anticipated; or
-
relate to business losses where you purchased the service wholly as a consumer for personal purposes.
Nothing in these Terms excludes or restricts liability where it would be unlawful to do so.
In particular, nothing excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any statutory consumer rights which cannot legally be excluded.
19. Ending Your Membership by Samsta Fitness
We may terminate or suspend your membership where there is a serious or repeated breach of these Terms, including:
-
fraudulent activity;
-
abusive or threatening behaviour towards staff or coaches;
-
misuse or unauthorised distribution of our content;
-
deliberate misuse of our systems; or
-
persistent failure to make payments which are properly due.
Where reasonably possible, we will explain the reason and give you an opportunity to remedy a breach before terminating the service.
Nothing in this section removes any refund or other rights you may have where we terminate a service which you have already paid for but have not received.
We may also decide not to continue providing coaching after completion of your current paid period. Where this happens, we will provide reasonable notice and will not charge you for future periods which we do not provide.
20. Changes to Prices, Services or These Terms
We may make reasonable changes to our website, application, exercise library, systems or the way in which services are delivered.
We may also update these Terms where necessary because of changes to our services, business, technology or applicable law.
The Agreed Price applicable when you purchase your Initial Commitment Period will not be retrospectively increased during that paid Initial Commitment Period.
If we propose to change the recurring price applicable to your ongoing monthly coaching after the Initial Commitment Period, we will provide reasonable advance notice before the new price takes effect.
Where required by applicable law, you will be given the opportunity to cancel your ongoing subscription before a material price change takes effect.
We will not use changes to these Terms to retrospectively remove rights you have already acquired.
21. Personal Data and Privacy
Samsta Fitness Ltd processes personal data in accordance with applicable UK data protection law, including the UK GDPR and Data Protection Act 2018.
Information concerning your health or fitness may constitute special category personal data and will be handled appropriately and only where there is a lawful basis for doing so.
Further information about what personal data we collect, why we collect it, how long we retain it, who we share it with and your legal rights should be set out in our Privacy Policy.
Agreeing to these Terms does not automatically constitute consent to receive optional marketing communications.
Where marketing consent is required, it will be requested separately and you may withdraw marketing consent or opt out of marketing communications at any time.
22. International Customers
Samsta Fitness is a UK business and provides services to customers in the UK and internationally.
These Terms are intended to operate under the laws of England and Wales.
However, if you live outside England and Wales, you may also benefit from mandatory consumer protection rights under the laws of the country or territory in which you live.
Nothing in these Terms is intended to remove rights which applicable law does not allow you to waive.
You are responsible for ensuring that participation in our online fitness services is lawful and appropriate in your country of residence.
23. Complaints
If you are unhappy with any aspect of the service, please contact us as soon as possible so that we have an opportunity to resolve the issue.
You may contact us through:
https://challenge.samstafitness.com/membership-management-form-page
We will aim to investigate complaints fairly and within a reasonable period.
Nothing in this complaints procedure affects your statutory consumer rights.
24. Governing Law and Disputes
These Terms and any contract between you and Samsta Fitness Ltd are governed by the laws of England and Wales, subject to any mandatory consumer protection laws which apply to you in your country of residence.
If you are a consumer resident in England or Wales, the courts of England and Wales will have jurisdiction.
If you are a consumer living elsewhere, you may also have the right to bring proceedings in the courts of the country in which you live where applicable consumer law provides that right.
25. Entire Agreement
These Terms, together with the service description, Agreed Price, payment information, Privacy Policy and any other terms expressly agreed with you in writing, form the agreement between you and Samsta Fitness Ltd.
If any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.
